Advanced Affordable Hearing shall be referred hereinafter as “AAH” and the customer shall be referred hereinafter as “Renter.” Renter agrees to abide by the terms and conditions described herein:
Reference Clause: AAH requires at minimum two or more personal references in the event the Renter cannot be contacted for reasons concerning either the Renter’s hearing aids(s) and or future payments. The references given to AAH must provide a valid phone number. Once the reference's contact information is provided they will be contacted by AAH prior to the first payment to confirm their validity. If the validity of any of the Renter’s references cannot be confirmed by AAH then no payment will be accepted.
Return Clause: Hearing aid(s) must be rented for a minimum period of 1 month. All fees for the initial month rental period are due at time of Rental Agreement and must be charged to a valid credit card. This first month renting cost and down payment fee are refundable within a 30 day period from the delivery date. Beyond this 30 day period, first month renting cost and down payment fee are non refundable. This is a monthly Rental Agreement. The Renter may return the hearing aid(s) at any time and this Agreement will be canceled provided all fees have been paid up to the date of return. If the hearing aid(s) is not returned during or at the end of the term, rental charges shall continue until the hearing aid(s) is returned. THE HEARING AID(S) MUST BE RETURNED TO THE AAH FULFILLMENT CENTER ONLY.
Credit Card Authorization: AAH is authorized to submit a credit card charge on the same day as the purchase day each month (i.e. purchase date is February 15th therefore the March charge date is March 15th) or the next business day, for the recurring rental cost to the renter's card on file plus any additional fees that may be due. Should the Renter be declared in default of this Agreement as outlined in the default clause, AAH is authorized to submit a charge for the total sum owed under this Agreement including any remaining balance due to purchase the hearing aid(s) plus any fees involved. If AAH takes possession of the hearing aid(s), a credit card charge may be submitted to the Renter's credit card for any damages and fees.
Default Clause: AAH can declare a Renter default if (a) Renter fails to pay a scheduled payment and late fee within 5 days after the due date of scheduled payment. (b) Renter provided inaccurate or misleading information on this agreement. (c) any other circumstance AAH feels endangers the safety of the equipment. If AAH declares a Renter to be in default, AAH must receive verification of the hearing aid(s) being shipped back by way of a tracking number within 48 hours. Failure to return a hearing aid(s) will result in the Renter's credit card charged the cost of the units plus any associated fees. A declined charge to a card constitutes a break in this agreement and will result in legal action.
Modification Clause: AAH reserves the right to modify this agreement at anytime. In the event of modification, Renter has the option to agree to the updated terms or terminate this contract and send the hearing aid(s) back.
Cancellation Clause: AAH reserves the right to cancel this program at anytime. In the event of cancellation, Renter has the option to purchase their hearing aid(s) at retail cost minus the down payment or return their hearing aid(s).
Auto Pay Clause: Renter authorizes the automatic debiting of the credit card on file for monthly payments under this agreement. Renter may request cancellation at anytime, however, the hearing aid(s) must arrive at AAH's Fulfillment Center before the automatic payments are stopped.
Loss Clause: Renter is responsible and liable for loss of the rented hearing aid(s). In the event of loss, the Renter will be responsible for compensating AAH for the cost of the equipment in question.
Repair and Maintenance Clause: Renter shall keep and maintain the hearing aid(s) during the terms of rental in a good state, with some normal wear and tear to be expected. AAH will make the appropriate repairs to keep the hearing aid(s) in proper working order. In the event of the rented hearing aid(s) needing to be returned for repairs, AAH will provide a replacement hearing aid(s) free of charge upon the verification of the hearing aid(s) shipped back by way of a tracking number. Renter will be charged retail cost for the replacement unit if there is no hearing aid returned in package. Renter is responsible and liable for a damaged hearing aid(s). There will be a deductible charge due to the Renter's credit card for the repair of a damaged hearing aid(s).
Exchange Clause: Renter may exchange a rental hearing aid(s) for another model at any time. Renter will be responsible for the new down payment as well as the price change in monthly rent. In the case of an exchange, AAH must receive confirmation, by way of a tracking number, of the Renter's current hearing aid(s) mailed back to the Fulfillment Center and receive payment, in full, for the new down payment before the exchanged units are sent.
FDA Statement: If the Renter has not been to a physician and sent a prescription to AAH, then the following applies. I have been advised by AAH that the Food and Drug Administration has determined that my best health interest would be served if I had a medical evaluation by a licensed physician (preferably a physician who specializes in diseases of the ear) before purchasing a hearing aid(s). I do not wish a medical evaluation before purchasing a hearing aid(s).
Severability Clause: Should any provision of this Agreement in whole or in part be or become invalid, impracticable or unenforceable, the validity of the other provisions shall not be affected thereby. In such a case, the invalid, impracticable or unenforceable provision shall be deemed to be replaced by a provision which, to the extent admissible according to the applicable laws, comes closest to the purpose of the invalid, impracticable or unenforceable provision. The same shall apply with respect to any omissions contained in this Agreement.
